1. THE PROPERTY: The property known as Le Four à Chaux, 221 Route du Mont, Les Bossons, Chamonix, France ("the property") is offered for holiday rental subject to confirmation by Suzanne Claret-Tournier ("the owner") to the renter ("the client").
2. THE CONTRACT: To reserve the property, the client should complete and sign the booking form and return it together with payment of a non-refundable deposit (25% of the total rental value). Following receipt of the booking form and deposit, the owner will send a confirmation invoice and statement (by e-mail or mail). This is a formal acceptance of the booking. Reservations made within eight weeks of the arrival date require full payment at the time of booking. The contract is governed by French Law and under the jurisdiction of the French Courts.
3. RENTAL PACKAGE: Two rental packages are available: Rental 1 (Basic): Rental, heating, lighting, electricity, hot water, final cleaning or Rental 2 (All-in): All of rental 1 plus one set of bed linen per week; one hand towel, one bath towel and one face flannel per person per week; the stocked fridge, toiletries, fruit and wine is provided on your arrival, it is not repeated if your stay extends to two weeks or more. You are expected to leave the studio in a tidy condition but you are not required to clean it before your departure.
4. PROVISIONAL BOOKINGS: Telephone or e-mail bookings will be held as provisional bookings for seven days from the date of their reception, by which time the appropriate deposit and signed booking form must have been received.
5. PAYMENT: The balance including a £100 security deposit (see clause 6) is payable not less than eight weeks before the arrival date. If payment is not received by the due date, the owner reserves the right to give notice in writing that the reservation is cancelled. The client will remain liable to pay the balance of the rent unless the owner is able to re-let the property. In this event the clause seven of these booking conditions will apply. Payment in US dollars is only accepted by bankers draft. In this case the security deposit will be returned in cash (euros) on the day of departure, less any deductions due to damage or breakages (if applicable - see clause 6). All and any bank charges are payable by the client.
6. SECURITY DEPOSIT: A security deposit of £100 is required in case of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the clients liability to the owner. The owner will refund the security deposit or balance due within two weeks after the end of the rental period.
7. CANCELLATION: Subject to clauses two and five, in the event of a cancellation, refunds of amounts paid will be made if the owner is able to re-let the property, and any expenses or losses incurred in do doing will be deducted from the refundable amount. The client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party's personal belongings, public liability, etc. since these are not covered by the owner's insurance.
8. DESCRIPTIONS:
All descriptions of contents and services are correct at this time, however,
the owner shall not be liable to the client:
i) for any temporary defect or stoppage in the supply of public services to
the property, nor in the respect of any equipment, machinery or appliance.
ii) for any loss, damage or injury which is the result of adverse weather conditions,
riot, war, strikes or other matters beyond the control of the owner.
iii) for any loss, damage or inconvenience caused to or suffered by the client
if the property shall be destroyed or substantially damaged before the start
of the rental period and in any such event, the owner shall, within seven days
of notification to the client, refund to the client all sums previously paid
in respect of the rental period.
9. PASSPORTS AND VISAS: All persons staying in the property must hold valid passports, and visas where necessary, for the duration of the rental. No monies will be refunded within eight weeks of arrival if travel problems are encountered due to invalid paperwork.
10. RENTAL PERIOD: The rental will commence at 5.00pm on the Saturday of arrival and finish at 11.00am on the Saturday of departure. The owner shall not be obliged to offer the accommodation before 5.00pm and the client shall not be entitled to remain in occupation after 11.00am.
11. OCCUPANCY: The maximum number to reside in the property must not exceed that noted on the booking form unless the owner has given written permission. The client agrees to be a considerate tenant and to take good care of the property and to leave it tidy. The owner reserves the right to make a deduction from the security deposit to cover additional cleaning costs if the client leaves the property in an unacceptable condition.
12. DEFECTS OR PROBLEMS: The client shall report to the owner without delay any defects or problems in the property or breakdown in the equipment, machinery or appliances in the property. Arrangements for repair and/or replacement will be made as soon as possible.
13. OWNER LIABILITY: Under no circumstances shall the owner's liability to the client exceed the amount paid to the owner for the rental period.
14. PETS: We regret that we are unable to accept pets.
15. SMOKING: For the comfort of subsequent
clients, smoking is not permitted in the studio. The studio and chalet are fitted
with smoke alarms.
